My husband and I are divorcing. He said I could get legal aid from base legal. If he goes to Camp Pendleton, I have to go to Miramar. Any ideas where it is located? If this is true? Any and all advice is helpful.

yes, only one spouse can use the base legal...

he should let you use camp pendleton; ALSO, if you use base legal, it has to be an "amicable" divorce, ie.. you have to agree on everything...

Why? It's every person for themselves. Let her take base legal and get screwed over, no way.

how is either party getting "screwed over" if they agree on everything?

why pay lawyers $$,$$$.cc if there is little or nothing to split... all base legal does is tell you what you rate or are supposed to pay... then they draw up the documents...

If it's a contested divorce or there is retirement involved, i'd pay the lawyers.

I know what amicable means, but why would you suggest he let her use it over him? One way or another they aren't both going to be able to use Pendleton, he works there she can travel as she pleases freely.

if its an amicable divorce with little or no assets, then only one of them really needs to go to legal... assuming they are both of average intelligence and not out to "screw" each other.... kind of like me and my ex... we just wanted to be apart and didnt have a lot of stuff to argue about...

one thing to consider is that base legal figures out alimony/spousal support based only off of BAH, where an out in town judge will base it off of Base Pay AND BAH. That's a considerable amount difference in most cases.

keep in mind, the Base Legal does NOT give you the Divorce, they just handle the paperwork..

And family support requirements are set by percentages in a Marine Corps Order.
